Use of Artificial Intelligence by C MOTTA Advogados
C MOTTA Advogados uses AI systems in a controlled environment, exclusively as technological support for legal research, information organization, document review and comparison, assisted document preparation, preparation of drafts, preliminary analysis, and the firm’s internal administrative activities. The use of these systems remains subordinate to the professional work of the lawyers and the responsible team and does not replace legal judgment, professional responsibility, confidentiality, human review, or the internal controls applicable to work performed for clients and to the management of the firm.
C MOTTA Advogados contracts and uses only AIs subject to restrictive parameters regarding confidentiality, environment segregation, and information security. The AIs authorized by the firm do not use, as a matter of contractual standard or applicable configuration, data belonging to C MOTTA Advogados, its clients, or third parties involved in professional matters to train, retrain, or improve general-purpose AI models. This restriction covers information entered into prompts, documents submitted for analysis, generated responses, interaction histories, and other records associated with authorized professional use.
The AIs used by C MOTTA Advogados operate in a dedicated and separate workspace intended for the firm’s institutional use. This segregation prevents the firm’s materials from being mixed with personal environments, external accounts, databases of other users, or third-party spaces, reducing the risk of improper exposure, inadvertent sharing, and loss of control over documents, personal data, confidential information, legal strategies, drafts, communications, and internal administrative records.
The AIs contracted by C MOTTA Advogados must operate with encryption in transit and encryption at rest. Encryption in transit protects data during its transmission between devices, systems, applications, and servers, reducing the risk of interception, capture, or reading by third parties while the information is being sent or received. Encryption at rest protects data when stored on servers, databases, repositories, file systems, or backups, so that any unauthorized access to the storage infrastructure does not, in itself, permit the intelligible reading of the protected content.
Access to the AIs and to the environments maintained within them is restricted to personnel of C MOTTA Advogados who require such access for the performance of their professional duties. Permission is granted on the basis of necessity, functional compatibility, and adherence to the firm’s internal rules, without broad, indiscriminate access or access unrelated to a legitimate professional purpose. The use of personal accounts, external solutions, extensions, integrations, open platforms, or environments not authorized by the firm is prohibited for activities involving professional information, client documents, confidential data, personal data, legal strategies, transactions, consultations, legal opinions, internal administrative activities, or any other material subject to a duty of confidentiality.
C MOTTA Advogados maintains strict internal rules for the use of AI. These rules define which systems may be used, which categories of information may be processed, which uses are prohibited, which precautions must be adopted in relation to personal data and confidential information, and which situations require additional validation before any use is made of the result produced. The use of AI is treated as technological support subordinate to the firm’s confidentiality policy, the professional obligations of the legal profession, data protection rules, internal information security controls, and the contractual commitments undertaken toward clients, counterparties, suppliers, and other third parties.
All content produced with the support of AI remains subject to human supervision, critical assessment, validation, and review by professionals of C MOTTA Advogados. No legal conclusion, strategic recommendation, contractual draft, legal opinion, client communication, external statement, or relevant administrative decision is issued or implemented solely on the basis of an automated result. Responsibility for the analysis, legal characterization, final drafting, professional decision, and administrative execution remains entirely with the professionals responsible for the work.
